Terms of Service & Legal Disclaimer

1. General Terms

Sporexpert is a mushroom cultivation management platform that provides educational tools, cultivation tracking, community features, and an online store. By accessing or using Sporexpert ("the Platform"), you agree to the following terms.

2. Legal Disclaimer — Psychoactive Species

2.1 Educational and Research Purpose Only

All information regarding psychoactive mushroom species (including but not limited to Psilocybe, Panaeolus, Gymnopilus, and Pluteus genera) provided on this Platform — including cultivation parameters, species profiles, and related data — is offered strictly for educational, scientific, and mycological research purposes.

Sporexpert does not promote, encourage, endorse, or facilitate the cultivation, possession, distribution, or consumption of psychoactive mushrooms in any jurisdiction where such activities are prohibited by law.

2.2 Spore Products

Mushroom spore products available in our store are sold exclusively for microscopy, taxonomy, and scientific research purposes. Spores do not contain psilocybin or psilocin. The purchase of spores does not constitute authorization or encouragement to cultivate psilocybin-containing mushrooms.

Spores must not be used for cultivation purposes in jurisdictions where such activity is illegal.

2.3 Applicable Laws

Users must be aware that:

  • United States (Federal): Psilocybin and psilocin are classified as Schedule I controlled substances under the Controlled Substances Act (21 U.S.C. § 812). Cultivation, manufacture, distribution, and possession of psilocybin-containing mushrooms are federal crimes punishable by up to 20 years imprisonment. Spores are legal federally as they do not contain controlled substances, except in California, Georgia, Idaho, and Florida where state laws restrict spore possession.

  • Mexico: Psilocybin and hallucinogenic mushrooms are classified as Group I psychotropic substances under the Ley General de Salud (Articles 245–249). Cultivation, harvesting, processing, possession, trade, and consumption are prohibited, with penalties of 10 to 25 years imprisonment under the Federal Criminal Code. Article 195 bis of the Federal Penal Code provides an exemption for traditional spiritual practices and indigenous ceremonies.

  • Other Jurisdictions: Laws regarding psilocybin mushrooms, spores, and cultivation vary significantly by country, state, and municipality. Some jurisdictions (Oregon, Colorado, and select municipalities in the United States) have enacted decriminalization or regulated access programs. Users must research and comply with all applicable laws in their specific jurisdiction.

2.4 User Responsibility

It is the sole responsibility of each user to understand and comply with all applicable federal, state, provincial, and local laws regarding psychoactive mushroom species, spores, cultivation, and possession in their jurisdiction.

Sporexpert assumes no responsibility or liability for any illegal use of information, products, or tools provided through the Platform. By using the Platform, you represent and warrant that you will comply with all applicable laws.

3. General Platform Use

3.1 Account Responsibility

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

3.2 Accuracy of Information

While Sporexpert strives to provide accurate cultivation data and educational content, we make no warranties regarding the completeness, reliability, or accuracy of information provided. Cultivation parameters, species data, and related content are provided "as is" for informational purposes.

3.3 Intellectual Property

All content, design, trademarks, and intellectual property displayed on the Platform are the property of Sporexpert or its licensors and are protected by applicable intellectual property laws.

4. Store & Purchases

4.1 Product Availability

Products are subject to availability. Sporexpert reserves the right to discontinue or modify products at any time.

4.2 Shipping Restrictions

Certain products may not be shipped to all jurisdictions due to legal restrictions. It is the buyer's responsibility to ensure that the purchase and receipt of products complies with local laws.

4.3 Refund Policy

Refund and return policies are detailed at the time of purchase and may vary by product type.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Sporexpert, its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Platform, including but not limited to:

  • Legal consequences resulting from cultivation activities
  • Loss of data or unauthorized access to accounts
  • Errors or omissions in cultivation data or species information
  • Product use outside of stated intended purposes

6. Modifications

Sporexpert reserves the right to modify these Terms of Service at any time. Continued use of the Platform after modifications constitutes acceptance of the updated terms.
